Details Emerge Surrounding Fulton Street Murder

34-year-old father of three Jason Lewis was shot in front of a diner Sunday near Vanderbilt Avenue.

Details surrounding the victim, suspect and moments leading up to the murder that occurred outside of a Fulton Street diner early Sunday morning are coming to light, with witnesses and surveillance video piecing together the fatal shooting.

Jason Lewis, 34, was at the counter of the Country House Diner at 887 Fulton St. at approximately 5 a.m. with his girlfriend, an off-duty NYPD officer, when an allegedly drunken Tyrone Gainer, 27, started bothering the woman, reported the New York Daily News and the New York Post

Gainer, who entered the diner with his girlfriend who allegedly is a 911 operator, knew the officer as she had previously been involved and had a child with his best friend, the Post reported.

When Lewis got involved in the argument, Gainer allegedly smacked him in the face.

But Lewis was not interested in fighting, saying they didn't "have to shed blood for this," the News said.

"She’s with me now. Why don’t you relax? Why are you yelling? Leave her alone," Lewis continued, the Post reported.

Lewis' girlfriend left the diner to move his illegally parked car and when she came back into the diner, she saw the men arguing and heard a pop, the Post continued.

Lewis then walked outside with his girlfriend and collapsed on the ground. EMS transported the man to Brooklyn Hospital where he was pronounced dead on arrival.

Gainer allegedly tried to flee after the shooting, but a friend of Lewis’ caught him and held him until police arrived, the Post reported. He was then arrested and charged with murder, criminal use of a firearm and criminal possession of a firearm.

Lewis, a cancer survivor and the owner of a fleet of dollar vans, had three children.
